Welcome to House Of FOSS ("we," "our," or "us"). By accessing or using our website https://houseoffoss.com and services (collectively, the "Service"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

1. Overview

House of FOSS provides infrastructure services for deploying and running software workloads. We operate as a neutral hosting and compute provider, not as a publisher, distributor, or owner of the software hosted on our platform.

By using the Service, you agree to these Terms.

2. Our Role

House of FOSS:

  • Provides compute, storage, and networking infrastructure

  • Operates containerized workloads at the direction of users

  • Charges only for infrastructure usage

House of FOSS does not:

  • Own, license, or sell hosted software

  • Modify application source code

  • Provide application-level features unless explicitly stated

  • Assume responsibility for the behavior or legality of hosted software

3. User Responsibilities

You are solely responsible for:

  • The software you deploy or host

  • Compliance with all applicable laws and regulations

  • Compliance with all applicable software licenses, including open-source, copyleft, and network copyleft licenses

  • Ensuring you have the rights to deploy and operate the software you use

House of FOSS does not provide legal advice or license compliance validation.

4. Open Source and Copyleft Software

Some software hosted on the platform may be subject to open-source licenses, including GPL and AGPL.

House of FOSS’s hosting and compliance practices for such software are governed by our Copyleft Hosting Policy, which is incorporated by reference into these Terms.

Users remain responsible for downstream use, modification, or redistribution of hosted software.

5. Acceptable Use

You may not use the Service to:

  • Host software that violates applicable licenses or third-party rights

  • Operate unlawful, harmful, or abusive workloads

  • Interfere with platform stability or other users

  • Introduce legal or operational risk to House of FOSS

We reserve the right to suspend or terminate workloads that pose compliance or security risks.

6. Intellectual Property

  • House of FOSS retains all rights to the platform, infrastructure, and services we provide

  • Users retain all rights to their software and data

  • No rights are transferred except as explicitly stated

Hosting software on House of FOSS does not grant us ownership or licensing rights over it.

7. Availability and Service Limits

The Service is provided on an “as-is” and “as-available” basis.

We do not guarantee uninterrupted operation, specific uptime levels, or data durability unless explicitly agreed otherwise.

8. Fees and Billing

  • Fees are based solely on infrastructure usage

  • Billing occurs according to published pricing

  • Users are responsible for all applicable taxes

  • Failure to pay may result in suspension or termination

9. Termination

You may stop using the Service at any time.

House of FOSS may suspend or terminate access if:

  • These Terms are violated

  • Payment obligations are unmet

  • Legal or compliance risk arises

10. Disclaimers and Limitation of Liability

House of FOSS is not responsible for:

  • Software behavior

  • Data loss within hosted applications

  • License violations by users

  • Third-party software defects

Liability is limited to the maximum extent permitted by law.

11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu, India for any disputes arising out of or relating to these Terms.

12. Dispute Resolution
In the event of a dispute, the parties agree to attempt to resolve the matter through informal negotiations. If resolution is not achieved, the dispute shall be resolved through binding arbitration in Chennai, Tamil Nadu, India, in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996.

13. Changes to Terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
